Couple Takes Divorce Case to Court Over Baby’s Surname

Shanghai: A unique case has emerged in Shanghai, China, where a couple filed for divorce over a disagreement regarding their newborn’s surname.

 

According to reports, the husband wanted the child to carry his family name, following the centuries-old tradition in China. The wife, however, insisted that the child be given her family name to ensure that her family’s identity is also recognised.

Both parties remained firm in their stance, and when reconciliation failed, the case went to court. The Shanghai court ruled in favour of the mother, granting her custody of the child.

The court emphasised that the child’s best interests and upbringing take precedence over the parents’ egos.

Traditionally, children in China inherit the father’s surname, but in recent years, more couples have started giving children the mother’s surname, particularly for second or third children.

Experts say this trend reflects the changing family dynamics and the growing emphasis on gender equality in China.
