The Islamabad High Court on Tuesday heard a case challenging the blocking of a citizen’s national identity card, with the chief justice raising serious concerns over the authority of lower courts to issue such orders.

During the hearing, Chief Justice Sarfraz Dogar expressed surprise at the actions of session and additional session judges who had ordered the blocking of citizens’ identity cards. He questioned how such significant decisions could be made at that level without clear legal justification.

Addressing the assistant attorney general, the chief justice remarked that he found it difficult to understand how session courts could issue directives to block identity cards, calling it a matter of concern. He noted that such orders carry serious implications for individuals, as identity cards are essential for accessing basic services and legal rights in Pakistan.

The court directed the assistant attorney general to assist in clarifying the legal basis for such actions and to explain under what authority session judges were issuing these directives. The chief justice emphasised the need for proper legal guidance to ensure that citizens’ rights are not adversely affected by arbitrary decisions.

The case highlights broader concerns about procedural oversight and the limits of judicial authority in administrative matters, particularly those involving national identity documentation.

After initial proceedings, the court adjourned the hearing, seeking further assistance from the government’s legal representative before proceeding with the case.

The outcome of the case is expected to provide clarity on whether lower courts have the jurisdiction to order the blocking of identity cards and what safeguards should be in place to protect citizens from misuse of authority.
