Federal Constitutional Court Rules Tax Authorities Can Conduct Raids Without Prior Notice

Islamabad: The Federal Constitutional Court has delivered a significant ruling on tax enforcement, stating that tax authorities can conduct raids at any time without prior notice.

The verdict was issued by Justice Aamer Farooq while deciding an appeal related to tax raids. The court clarified that there is no requirement for an ongoing case against a taxpayer before conducting a raid.

The court rejected the argument that conducting a raid without a pending case should be declared illegal. It noted that the law does not impose such a precondition.

According to the ruling, Parliament has granted broad powers to tax authorities for the enforcement of tax laws. The court emphasized that it cannot insert conditions into the law that the legislature has not explicitly included.

Five IHC Judges Challenge Transfer to Federal Constitutional Court

The judgment further stated that where legislative language is clear and unambiguous, courts are not authorized to create limitations or contradictions in its interpretation.

However, the decision requires that the Commissioner must record in writing the specific legal violation forming the basis of the raid. Tax officials are fully authorized to seize computers, documents, and accounts during such operations.

The court ultimately upheld the decision of the Sindh High Court and dismissed the appeal, thereby reinforcing the legal standing of tax authorities’ enforcement powers.
