Mother retains child custody despite remarriage: Lahore High Court ruling

In a significant ruling, the Lahore High Court has granted custody of a 10-year-old child to the mother, despite her remarriage—overturning a previous decision that transferred custody to the father.

Justice Ahsan Raza Kazmi, in his written verdict, stated that a mother’s remarriage does not automatically disqualify her from retaining custody. The court emphasized that there is no absolute principle suggesting a mother loses custody rights solely due to remarriage.

The judgment highlighted that the child had been living with the mother since birth and that sudden separation could have a detrimental impact on the child’s mental and emotional well-being. Prioritizing the child’s welfare and stability, the court ruled in favor of the mother.

This decision reinforces the legal stance that custody should be based on the child’s well-being, not solely on the personal circumstances of either parent.
